Marvel’s Phase One Blu-ray Mega Set Delayed Over Lawsuit

Marvel’s The Avengers is set to be released on September 25, and along with the normal DVD, Blu-Ray, DVD/Blu-Ray versions of the film, Marvel was going to release a box set that included not only The Avengers, but Blu-Ray copies of Iron Man 1 & 2, Thor, Captain America, and The Incredible Hulk along with a treasure trove of extras. The box set was called “Marvel’s Phase One Blu-ray Box Set “, and what seperated this set from most collections was the packaging. The movies come encased in a replica of the breifcase that was used in the film to transport the cosmic cube, even including a glowing replica of the cube itself. Unfortunately the briefcase is copyrighted by the German luggage company Rimowa BhmbH. While the proper permissions were granted to use the breifcase in the films leading up to and including The Avengers, no such permission was granted for the production and selling of their design for the box set.

A suit was filed in California court. The German company made the following statement.

Marvel did not obtain any license or authorization from Rimowa to make replica copies of the case for any purpose . . . the plastic ‘replica case’ [is] a close copy of Rimowa’s Topas attaché case in every respect but quality — from the proportions and coloring, to the style of the handle and latches, and, of course, in the use of the trademarked parallel ridges around the body of the case

The set has been pulled off of online retailers, and they have stopped taking pre-orders. Only time will tell if this is a temporary hiccup. The film has grossed over $1.5 billion worldwide so it’s not a stretch to imagine that the bag maker may want to re-negotiate a better deal for themselves. We’ll keep you posted.

      I did indeed. Unfortunately, I've been informed it has been delayed "temporarily". So who knows when I'll get it.
